These Terms of Service govern your use of Carrington, our Mobile App and website located at https://www.carrington.app, and any related services provided by 9 RESE' LLC.
When you create a Carrington account or use Carrington, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from further using the app, accessing our website, or using any other services provided by 9 RESE' LLC.
If you access or download Carrington from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions including the Google Apps Terms of Service.
We, 9 RESE' LLC, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and notify you through the app and/or the email address you provided when you created your account.

Limitations of Use
By using Carrington and our website, you warrant on behalf of yourself, any entity who you represent who has entered into these Terms of Service, and your users that you will not:
- modify, copy, prepare derivative works of, decompile, or reverse engineer Carrington or any materials and software contained within Carrington or on our website;
- remove any copyright or other proprietary notations from Carrington or any materials and software contained within Carrington or on our website;
- transfer Carrington or any of its associated materials to another person or "mirror" the materials on any other server;
- knowingly or negligently use Carrington or any of its associated services in a way that abuses or disrupts our networks or any other service 9 RESE' LLC provides;
- use Carrington or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
- use Carrington or its associated services in violation of any applicable laws or regulations;
- use Carrington to send unauthorized advertising or spam;
- harvest, collect, or gather user data without the user's consent; or
- use Carrington or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.
Intellectual Property
The intellectual property in the materials in Carrington and on our website are owned by or licensed to 9 RESE' LLC. You may download Carrington, to view, use, and display the application on your mobile device for your personal use only.
This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or these Terms of Service, and may be terminated by 9 RESE' LLC at any time.
Automatic Updates
You give us permission to download and install updates to Carrington on your device in accordance with your privacy preferences. This permission can be revoked at any time by deleting Carrington from your device.
Experimental Outputs — No Reliance
IMPORTANT — PLEASE READ CAREFULLY.
Carrington presents space-weather information, geomagnetic and solar data, earthquake-related forecasts and probability estimates, and wellness-related information. These outputs are EXPERIMENTAL, are generated by automated and research-stage models (including statistical, machine-learning, and generative-AI systems), and may be inaccurate, incomplete, delayed, or wrong. They are provided for general informational, educational, and research purposes ONLY.
You acknowledge and agree that:
- Earthquake and space-weather forecasts, probabilities, gauges, and map layers are experimental estimates that do NOT provide certainty, are NOT validated for life-safety use, and must NOT be relied upon for emergency, evacuation, disaster-response, insurance, engineering, aviation, maritime, energy-grid, or any operational decision-making.
- Wellness and health-related content is NOT medical advice, is NOT a substitute for professional medical care, and must NOT be used to diagnose, treat, cure, or prevent any condition. Always consult a qualified health professional. In an emergency, contact your local emergency services.
- Carrington is not an official NOAA, USGS, government, emergency-management, or public-safety alerting system, and is not a substitute for official alerts, warnings, instructions, or emergency services.
- You use the information in Carrington at your own risk and are solely responsible for any decisions you make based on it.
Disclaimer of Warranties (AS IS)
Carrington and all materials, data, forecasts, models, and AI-generated content in Carrington and on our website are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind.
To the maximum extent permitted by applicable law, 9 RESE' LLC, its suppliers, and its data providers expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties or conditions of merchantability, fitness for a particular purpose, title, accuracy, completeness, reliability, timeliness, availability, uninterrupted or error-free operation, and non-infringement.
Without limiting the foregoing, we make NO warranty or representation that the space-weather, earthquake-forecast, or wellness outputs are accurate, reliable, current, or fit for any particular purpose, and we do not warrant that the service will be uninterrupted, secure, or free of errors, viruses, or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall 9 RESE' LLC, its officers, members, employees, contractors, suppliers, or data providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to:
- your use of, reliance on, or inability to use Carrington, our website, or any related services;
- any space-weather, earthquake-forecast, wellness, or AI-generated output, or any decision made or action taken in reliance on it; or
- any errors, inaccuracies, omissions, delays, or interruptions in the materials or service,
even if 9 RESE' LLC has been advised of the possibility of such damages.
To the maximum extent permitted by law, the total aggregate liability of 9 RESE' LLC arising out of or relating to these Terms of Service or the service shall not exceed the greater of (a) the amount you paid us, if any, for the service in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 20.
Because some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
Accuracy of Materials
The materials appearing in Carrington or on our website are not comprehensive and are for general information purposes only. To the extent permitted by law, 9 RESE' LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in Carrington or on our website. We may make changes to the materials at any time without notice.

Notice regarding Apple
To the extent that you are using or accessing Carrington on an iOS device, you acknowledge and agree to the terms of this clause. You acknowledge that these Terms of Service are between you and 9 RESE' LLC only, not with Apple Inc. (Apple), and Apple is not responsible for Carrington and any materials available in Carrington.
Apple has no obligation to furnish you with any maintenance and support services with respect to Carrington.
Apple is not responsible for addressing any claims by you or any third party relating to Carrington or your use of Carrington.
You hereby represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.
Right to Terminate
We may suspend or terminate your Carrington account and right to use Carrington and these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
Severance
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict-of-laws principles. Subject to the "Dispute Resolution" section below, you irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.
Dispute Resolution
Before either you or 9 RESE' LLC starts a lawsuit or other formal proceeding related to Carrington, you and 9 RESE' LLC agree to first try to resolve the dispute informally and in good faith.
To start informal resolution, the party with a concern should send a written notice that describes the dispute, the account email address involved (if any), and the relief requested. You may send notices to [email protected] or to 325 Montoya St NW, Albuquerque, NM 87104. We may send notices to the email address associated with your account.
The parties will try to resolve the dispute for at least thirty (30) days after notice is received. If the dispute is not resolved during that period, either party may proceed in the courts described in the "Governing Law" section, subject to applicable law.
This informal-resolution process does not prevent either party from seeking urgent injunctive or equitable relief, bringing a qualifying individual claim in small-claims court, or reporting a concern to or filing a complaint with any government agency.
These Terms do not include a mandatory arbitration clause, class-action waiver, or jury-trial waiver unless such language is later added after legal review and accepted by users as part of updated Terms of Service.
